1. Using FlockSpot

FlockSpot is a mobile application for tracking, identifying, and sharing bird sightings. You must be at least 16 years old to create an account. You are responsible for keeping your login details secure and for everything that happens under your account.

2. Your content

When you log a sighting, upload a photo, or post in the community feed, you keep ownership of that content. By posting it on FlockSpot, you give us a licence to display, store, and distribute it within the app, including to other users who follow you or interact with the feed. You are responsible for making sure you have the right to share anything you post.

We ask that you only post content that is your own, accurate to the best of your knowledge, and respectful of other birders and the wildlife you photograph.

3. Acceptable use

You agree not to:

• Submit false or deliberately misleading bird sightings, especially when science contribution to eBird is enabled.
• Harass, impersonate, or abuse other users.
• Use FlockSpot to harm wildlife or disturb sensitive nesting or breeding sites.
• Attempt to reverse-engineer, scrape, or disrupt the app or its underlying services.
• Use automated tools to create accounts or generate fake activity.

4. Free and Pro features

FlockSpot offers a free tier with no time limit, and an optional Pro subscription that unlocks additional features such as route tracking, unlimited identification, and smart notifications. Pricing, including any early-bird offers, is shown in the app and may change over time. Subscriptions are billed and managed through the Apple App Store or Google Play, and are subject to their respective terms, including how to cancel or request a refund.

5. Bird identification accuracy

FlockSpot uses AI models and third-party data (including iNaturalist, eBird, and Wikipedia) to help identify species. While we aim for accuracy, identification suggestions are not guaranteed to be correct. Always use your own judgement, especially for rare or sensitive sightings, and double check before submitting anything to formal scientific records.

6. Science contribution

If you opt in to share sightings with eBird, you are contributing to a public scientific database maintained by the Cornell Lab of Ornithology. This data may be used by researchers and is subject to eBird's own terms, separate from FlockSpot's. We are not responsible for how eBird or third-party researchers use data once it has been shared with their platform.

7. Availability

FlockSpot is launching first in Europe, with other regions following afterwards. We aim to keep the app running smoothly, but we do not guarantee uninterrupted access, and features may change, be added, or be discontinued as the app evolves.

8. Termination

You can delete your account at any time from Settings. We may suspend or terminate accounts that violate these terms, particularly in cases of abuse, fraud, or harm to other users or wildlife.

9. Disclaimer

FlockSpot is provided as is. We work hard to keep it accurate and reliable, but we cannot guarantee the app, its data, or its identification features will always be error-free or available without interruption.

10. Changes to these terms

We may update these terms as FlockSpot grows. If changes are significant, we will notify you in the app before they take effect.
